These Terms and Conditions (“Terms”) govern your access to and use of the website located at brooklynemerge.com (the “Site”), operated by Brooklyn Emerge Inc. (“Brooklyn Emerge,” “we,” “our,” or “us”), a 501(c)(3) nonprofit organization incorporated in the State of New York.
By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
- Use of the Site
1.1 Eligibility
The Site is intended for individuals who are at least 13 years of age. By using the Site, you represent that you meet this requirement. Use of the Site by individuals under 13 must be under direct parental or guardian supervision.
1.2 Permitted Use
You may use the Site for lawful purposes only. You agree not to:
● Use the Site in any way that violates applicable federal, state, or local laws or regulations
● Impersonate any person or entity or misrepresent your affiliation with any organization
● Upload or transmit any content that is harmful, offensive, defamatory, or infringing on another’s rights
● Attempt to gain unauthorized access to any part of the Site or its underlying systems
● Use automated tools, bots, or scrapers to extract data from the Site without our prior written consent
● Interfere with or disrupt the operation of the Site or the servers and networks connected to it
1.3 Account Registration
Certain features of the Site (such as program registration) may require you to create an account or submit a registration form. You are responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
- Program Registration and Participation
Brooklyn Emerge offers a range of community programs including ESL, GED, TLC, and computer classes; career grooming and job placement; after-school and homeschooling support; youth internship programs; and meal distribution services.
By registering for any program through the Site or otherwise:
● You agree to provide accurate and complete information
● You understand that program availability is subject to capacity and eligibility requirements
● You acknowledge that participation in certain programs may require additional consent forms, including for minors
● You agree to comply with all program rules and the direction of Brooklyn Emerge staff and volunteers
Brooklyn Emerge reserves the right to refuse or revoke program participation at its sole discretion if these Terms or program-specific rules are violated.
- Donations
Brooklyn Emerge accepts donations in support of its mission. If you make a donation through the Site:
● All donations are voluntary and generally non-refundable unless otherwise required by law
● Brooklyn Emerge is a registered 501(c)(3) organization (EIN: 85-1491905); donations may be tax-deductible to the extent permitted by law. Please consult your tax advisor.
● We will use donations in accordance with our organizational mission and any donor-specified restrictions communicated to us in writing
Brooklyn Emerge does not guarantee any specific outcome from donations. All contributions are used at the discretion of the organization’s leadership to advance its charitable mission.
- Intellectual Property
4.1 Our Content
All content on the Site — including text, images, logos, graphics, videos, and program materials — is owned by or licensed to Brooklyn Emerge Inc. and is protected by applicable copyright, trademark, and other intellectual property laws.
You may view and print content from the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.
4.2 Your Submissions
If you submit content to us (such as photos, stories, testimonials, or feedback), you grant Brooklyn Emerge a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our programs, fundraising, and communications, without compensation to you.
You represent that you own or have the right to submit any content you provide and that it does not violate any third party’s rights.
- Disclaimer of Warranties
The Site and all content, programs, and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Brooklyn Emerge does not warrant that:
● The Site will be available at all times or free from errors or interruptions
● Any information on the Site is accurate, complete, or current
● The Site is free of viruses or other harmful components
- Limitation of Liability
To the fullest extent permitted by applicable law, Brooklyn Emerge Inc., its officers, directors, employees, and volunteers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from:
● Your use of or inability to use the Site
● Any errors or omissions in Site content
● Unauthorized access to or alteration of your data
● Any other matter relating to the Site or our programs
Our total liability to you for any claim arising out of these Terms shall not exceed one hundred dollars ($100.00).

You agree to indemnify, defend, and hold harmless Brooklyn Emerge Inc. and its affiliates, officers, directors, employees, and volunteers from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:
● Your use of the Site or our programs
● Your violation of these Terms
● Your violation of any applicable law or regulation
● Any content you submit to us

Brooklyn Emerge does not endorse, control, or assume any responsibility for the content, privacy practices, or availability of any third-party sites. Any disputes arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Kings County (Brooklyn), New York. You consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. - Entire Agreement
